Man charged with killing over subway seat

NEW YORK, Nov 21, 2009 (UPI via COMTEX) -- A New York man was arrested early Saturday after he allegedly killed another passenger in a dispute over a seat on the uptown D train, police said.

Gerardo Sanchez, 37, was charged with second-degree murder and criminal possession of a weapon, the steak knife allegedly used in the killing, The New York Times reported. The knife was found in the subway car.

The stabbing occurred around 2 a.m. while the train was moving between the stop at Rockefeller Center and the station at 53rd Street and Seventh Avenue. Witnesses told police the victim, who had not been identified late Saturday, refused to move a bag so Sanchez could sit down, a spokesman for New York City Transit said.

Sanchez, who lives in the Bronx, boarded the train at Rockefeller Center, police said.
